Custodio Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Custodio mobile application, website, and related services (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
1. About Custodio
Custodio Pty Ltd ("Custodio", "we", "us", "our") provides a consumer financial safety and scam-protection service designed to help users identify unusual or potentially harmful financial activity and, where chosen, notify their trusted Guardians.
Custodio operates through a Nominated Account Data Collection: Direct to Consumer access model of Adatree Pty Ltd, an Accredited Data Recipient (ADR) with accreditation number ADRBNK000071 under the Australian Consumer Data Right.
2. Eligibility
You must:
- Be at least 12 years old
- Have legal capacity to enter into these Terms
- Use the Service only for lawful personal purposes
- Be the holder of at least one current bank account issued by an Australian Authorised Deposit-taking Institution (ADI)
You are responsible for ensuring the accuracy of the information you provide.
3. Nature of the Service
Custodio provides:
- Monitoring of consented financial data
- Alerts regarding unusual or potentially concerning activity
- Optional notifications to nominated Guardians
Custodio does not:
- Provide financial, tax, legal, or investment advice
- Guarantee the prevention or detection of scams or fraud
- Act as a bank, payment provider, or financial institution
You remain solely responsible for your financial decisions and actions.
4. Custodio.AI
4.1 Opt-in feature
Custodio offers an optional artificial intelligence feature ("Custodio.AI") that is only activated if you choose to enable it within the app. When enabled, Custodio.AI uses your shared data, including CDR data you have consented to share, to generate insights, summaries and suggestions related to your activity.
4.2 Limitations of artificial intelligence
You acknowledge and agree that:
- Custodio.AI uses artificial intelligence and related technologies that may produce inaccurate, incomplete or misleading outputs
- Custodio.AI artificial intelligence generated content may contain errors, omissions or outdated information
- Custodio.AI does not constitute financial, tax, legal or investment advice
- You should not rely on Custodio.AI outputs when making decisions
- Custodio is not liable for any loss or damage arising from reliance on Custodio.AI artificial intelligence generated content
Custodio.AI is provided as a supportive and informational tool only. You remain solely responsible for evaluating any information it provides and for your own decisions.
4.3 Data use
When Custodio.AI is enabled, your shared data may be processed by AI models to deliver the feature. This processing is subject to the same privacy, security and CDR safeguards described in these Terms and the Custodio Privacy Policy. You may disable Custodio.AI at any time, which will stop AI processing of your data from that point forward unless re-enabled.
5. Consumer Data Right (CDR)
5.1 Consent
Custodio accesses banking data only with your explicit consent and strictly in accordance with the Consumer Data Right rules.
You may withdraw consent at any time. Withdrawal stops further data collection but does not affect lawful processing already performed.
5.2 Data handling
CDR data is accessed and handled through Adatree's accredited CDR environment and is used solely for the purposes described in your consent.
6. Guardians
If you choose to nominate a Guardian:
- You authorise Custodio to share limited alert-related information with that Guardian
- Guardians do not receive full banking data or transaction histories
- You may add or remove Guardians at any time
You are responsible for ensuring your Guardian understands their role.
7. Account security
You are responsible for:
- Keeping your login credentials secure
- All activity that occurs under your account
- Notifying Custodio promptly of any unauthorised access
We may suspend access if we reasonably believe your account is compromised.
8. Fees and availability
Unless otherwise stated, the Service is currently provided without charge. Custodio may introduce fees or subscription plans in the future, with reasonable prior notice.
We do not guarantee uninterrupted availability and may suspend or modify the Service for maintenance, security, or regulatory reasons.
9. Acceptable use
You must not:
- Use the Service for unlawful, abusive, or fraudulent purposes
- Attempt to reverse engineer or interfere with the Service
- Provide false or misleading information
- Circumvent security or consent mechanisms
We may suspend or terminate access for breaches of these Terms.
10. Intellectual property
All intellectual property in the Service, including software, branding, content, and designs, remains the property of Custodio or its licensors.
You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal purposes only.
11. Suspension and termination
We may suspend or terminate your access if:
- You breach these Terms
- Required by law or regulator
- Necessary to protect users, Custodio, or third parties
You may stop using the Service at any time by deleting your account.
12. Disclaimer
To the maximum extent permitted by law, the Service is provided "as is" and "as available".
Custodio makes no warranties that:
- Alerts will be timely, accurate, or complete
- The Service will detect all scams or illegitimate or harmful activity
- The Service will be uninterrupted or error-free
- Any information provided is accurate or reliable
13. Limitation of liability
To the maximum extent permitted by law:
- Custodio is not liable for indirect, incidental, or consequential loss
- Custodio's total liability is limited to the amount paid by you (if any) for the Service in the preceding 12 months
Nothing in these Terms excludes non-excludable rights under Australian Consumer Law.
14. Privacy
Your use of the Service is subject to the Custodio Privacy Policy, which explains how personal information and CDR data are handled.
15. Changes to these Terms
We may update these Terms from time to time. The latest version will be available via the app and on our website. Continued use constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of New South Wales, Australia. Courts of that jurisdiction have exclusive authority.
